Supreme Court decisions, GPS tracking & Cameras on School Buses

Andy and Paul talked about two Supreme Court decisions.  The first involved the right to privacy vs. the right to be safe theme, where the police put a GPS tracking device on a suspected drug dealer’s car.  First convicted, the dealer claimed his 4th Amendment right to privacy was violated.  The Supreme Court eventually got the case and agreed, indicating that police needed a Warrant before placing such a device intended for “extended” use.  Thus the question becomes, what is extended use?

Next, Andy asked Paul about another Supreme Court recent decision, where the Justices ruled that a binding arbitration provision in a consumer credit card contract was legal.  Here, poor consumers who were not told about onerous expense provisions were denied of their right to file a lawsuit against the credit card companies because of a provision in the contract requiring binding arbitration.  Guess who picks the arbitrator?

Finally, Andy asked Paul about the movement in Montgomery County, Maryland to fine drivers who illegally pass school buses when the bus has it lights and STOP sign arm displayed.  Debate is going on in the county now about the amount of this potential fine, specifically whether the fine should be $100 or $250.  Paul offered that it should be $1500.

Paul’s legal tip for the day involved picking the “right” doctor if you are involved in an auto accident.   If the doctor works for insurance companies doing what they call “Independent Medical Exams,” stay away!

Fast & Furious, Murray, Knox, Privacy ….

The trial of Dr. Conrad Murray charged with Manslaughter in the death of Michael Jackson continues and we’ll be giving focus to the expert testimony offered this past week.  Paul will be helping out with how deviations from Standards of Care in this case, just may lead to a guilty verdict.  We’ll also look at what the defense has planned as they present their side of the story next week.

Fast and Furious was a U.S. employed strategy to slow down the illegal sale and purchase of firearms … Unfortunately, Fast and Furious turned out to best describe the finger pointing now going on over who is responsible for what is, at a minimum, a frightening misuse of authority to implement an ill-conceived plan. We’ll be asking for your thoughts.  Paul shares his views later in the program.

American Student Amanda Knox has returned a free woman after years in an Italian prison and while acquitted of the more serious charges, shades of Casey Anthony clouded the case with lies to law enforcement officials.  In Celebrity news, the FBI makes an arrest in the Scarlett Johansson case, and We say OOPS SHE DID IT AGAIN to Lindsay Lohan.  In our news follow ups, we feature the Supreme Courts struggle with the fourth amendment…this time strip searches cause questions about security versus privacy – Gary Giordono’s attorney petitions for his release.

Remembering September 11, 2001 …

There are dates that stand out in the history of our planet but, perhaps, none so immediately recognizable to U.S. Citizens as 9/11.  We will, as is our custom, begin the show with the top legal news headlines and today’s centers around the heightened terrorist alert issued recently and devote the first portion of the program to honor all those that have made the ultimate sacrifice in connection with September 11, 2001.

Later in the program, we’ll return to legal news headlines and the work of several judges around the country.  A New Mexico magistrate blocks plans to verify immigrant driver’s liceneses, another throws out a plea agreement and a judge in France orders a man to pay his wife $14,000.00 … Paul will tell you what that money was for later in the program … ok, I’ll tell you…never good at keeping secrets…he made the guy pay for NOT having sex with his wife.  In another international case, an Aruban Judge rules against Gary Giordono and the mystery of another woman disappearing from the tropical island continues.

We’ll also learn a bit more about Disorderly Conduct and protest arrests as we follow up on the Daryl Hannah arrest and in the same segment we have updates on several cases we’ve been following here.
